The
present application for leave to prefer appeal is directed against
the judgement and order dated 1.9.2009 passed by the learned Addl.
Sessions Judge in Sessions Case No.17 of 2009, whereby the accused
have been acquitted for the offences punishable under Sections 302,
307 read with 120B of IPC read with Section 25(1)(AA) of the Arms
Act read with 135 of the Bombay Police Act.

Considering
the facts and circumstances, it appears to us that there is a good
case to be considered in the appeal. Hence, leave deserves to be
granted and, therefore, granted.

The
application is disposed of accordingly.
