Sri Raj Karan Yadav has accepted notice on behalf of the respondent.
He prays for and is granted three weeks’ time to file counter affidavit.
Rejoinder affidavit may be filed within two weeks thereafter.

It is apparent that the Workman Conductor was found guilty of taking
39 passengers without tickets and the Labour Court found that the
charge was duly proved but only on the ground that this was the first
instance, it ordered reinstatement and partial back wages. Prima facie
this approach of the Labour Court is against the principles of law and
accordingly, the operation of the Award dated 5th of February 2010
shall remain stayed till the next date.
