The contention of the petitioner is that he is validly appointed Headmaster of
Janta Vikas Laghu Madhyamik Vidyalaya Phulvariya, District Sant Kabeer
Nagar and by means of the impugned order the signatures of respondent no. 5
has been approved as Headmaster of the said institution though the petitioner
is neither under suspension nor has retired but is still working and holding the
office of Headmaster of the institution concerned and the respondent no. 5 is
not even an Assistant Teacher of the institution.
Learned Standing Counsel prays for and is allowed three weeks’ time to file
counter affidavit. Rejoinder affidavit, if any, may be filed by the petitioner
within a week thereafter.
Issue notice to respondents no. 4, 5 and 6 returnable at an early date. Steps to
be taken within three days. They may also file counter affidavit within two
weeks after receipt of notice.
Until further orders of this Court the operation of the order dated 25.09.2009
(Annexure-1 to the writ petition), in so far as it approves the signatures of
respondent no. 5 as Headmaster of the institution concerned, shall remain
stayed. It is further directed that the petitioner’s functioning as Headmaster of
the institution concerned shall also not be interfered by the respondents.
