ORAL
ORDER

(Per
: HONOURABLE MR.JUSTICE KS JHAVERI)

1. By
way of the present petition the petitioner has prayed to direct the
respondent no. 4 to decide the statutory complaint of the present
petitioner dated 04.02.2005 at the earliest and preferably within a
period of one month.

2. This
Court vide interim order dated 22.07.2005 observed as under:

“Notice
returnable on August 17, 2005. Shri Jitendra Malkan, learned
Assistant Solicitor General of India waives service of notice on
behalf of Respondents no. 1,2 and 4. By Court order dated January
24, 2005 passed in Special Civil Application No. 6356 of 2004,
competent authority has been directed to dispose of statutory appeal
preferred by the petitioner Manojkumar Gupta within a period of four
months from its receipt. This period is over but the appeal has not
been decided. Consequently, this petition has been filed directing
the respondents to decide the appeal. Therefore, respondents will
decide the appeal and place order along with reply in this case. It
is made clear that the filing of this petition will not prevent the
competent authority from disposing of the appeal. Post the matter on
August 17, 2005.”

3. In
view of the above order and the relief prayed for, it appears that
the petition has become academic. Petition, therefore, stands
disposed of as having become academic. Notice is discharged.
