Background
1. The Applicant filed an RTI application dt.30.7.08 with the CPIO, NWR,
Jodhpur. He requested for information against 2 points regarding the enquiry
report on the alleged sexual harassment meted out to Mrs.Usha Ashiaq. He
wanted copies of all the correspondences file notings, complaints,
representations etc. The CPIO replied on 6.8.08 denying the information as it
related to a third party. Not satisfied with the reply, the Applicant filed an
appeal dt.2.9.08 with the Appellate Authority reiterating his request for the
information. On not receiving any reply, he filed a second appeal dt.3.10.08
before the CIC stating that he has not received any information.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 9, 2009.
3. Mr.Anurag Kapil, Sr.DFM, Mr.Shirish Kesaruanj, ADRM and Mr.Kailash Panwar,
Sr.DPO represented the Public Authority.
4. The Applicant was not during the hearing.
Decision
5. The Respondents submitted that on receipt of the first appeal from the
Appellant, the Public Authority decided that since the Appellant is the husband
of Mrs.Usha Ashiaq all the information sought should be provided to him.
Accordingly, the Appellate Authority replied on 26.9.08 providing all the
information running into 100 pages. The Respondent added that the
Appellant wrote a letter to them on 3.10.08, the date on which he filed a
second appeal, stating that he required certified copies which were duly
furnished to Appellant on 6.10.08.
6. The Commission, on perusal of the information provided, observed that
complete information has been provided and accordingly disposes of the
appeal.
