Learned A.G.A. files counter affidavit, which is taken on record.

Heard the learned counsel for the applicants and learned A.G.A. for the
State as well as perused the documents available on the record.

The accused-applicants Girija Shankar Verma and Amarjeet Verma are
involved and detained in Case Crime No. 961 of 2009, under Sections 147,
304, 308, 323, 325, 504, 506 I.P.C., from Police Station Tarun, District
Faizabad and they have applied for bail.

The submission of the learned counsel for the accused applicants is that
the co-accused Jang Bahadur Verma, Ram Karan Yadav and Kalawati Devi
have already been ordered to be released on bail by another Bench of this
Court, vide order dated 29.4.2010, passed in Criminal Misc. Case No. 1794
(B) of 2010, order dated 27.4.2010, passed in Criminal Misc. Case No. 3264
(B) of 2010 and the order dated 25.2.2010, passed in Criminal Misc. Case No.
1581(B) of 2010 respectively. The role of the present accused applicants is
similar to the role of co-accused Jang Bahadur Verma and Ram Karan Yadav,
who have already been ordered to be released on bail. Therefore, accused
applicants also deserve to be released on bail.

Learned A.G.A. assisted by the learned counsel for the complainant
opposed the bail applicant of the accused applicants. Learned counsel for the
complainant argued that on the pointing out of the present accused applicants,
Fawda and lathi were recovered by the Investigating Officer from their house.
Their case stands on different footing. Therefore, they do not deserve to be
released on bail.

Considered the submissions of the learned counsel for the accused
applicants and the learned A.G.A. as well as learned counsel for the
complainant.

The prosecution allegation against the accused applicants and co-
accused Jang Bahadur Verma and Ram Karan Yadav is same who have already
been ordered to be released on bail. Keeping in view the totality of the facts
and circumstances of the case, without expressing any opinion on the merit of
the case, the accused applicants may also be released on bail.

Let applicants Girija Shankar Verma and Amarjeet Verma be released
on bail in the aforesaid case crime number on their furnishing a personal bond
with two sureties each in the like amount to the satisfaction of the court
concerned.
