1.0 The
matter was mentioned in the morning by the applicant – convict
for urgent circulation today as he is on Temporary Bail and on expiry
of the Temporary Bail, he is required to surrender in jail. The
permission was granted. Papers are received from the Registry.
2.0 Present
application is filed by the applicant seeking extension of Temporary
Bail granted by this Court by order dated 25th March 2011
in Criminal Misc. Application No. 4054 of 2011 for further 30 days as
the work of constructing the house is incomplete. In support of the
application, a Certificate from Shri Navagam (Than) Gran Panchayat,
Tal.: Chotila, District: Surendranagar is enclosed. Along with that,
bills for purchase of building material are enclosed. Besides, the
applicant – convict submitted that there is marriages of his
nephew and niece on
8th May 2011 and 9th May
2011. He requests that Temporary Bail may suitably be extended.
3.0 Rule.
Learned Additional Public Prosecutor Mr. Pandya waives service of
process of Rule.
4.0 The
contents of the application and the documents accompanied appear to
be genuine and hence, this Court is of the opinion that interest of
justice will be served if the Temporary Bail, granted by this Court
by order dated 25th March 2011 in Criminal Misc.
Application No. 4054 of 2011 is extended. Accordingly, the
application is allowed. The Temporary Bail granted by this Court is
extended by 30 days from the date of expiry of earlier
Temporary Bail period, on the same terms and conditions.
4.1 The
applicant – convict shall surrender to the jail authorities on expiry
of the Temporary Bail period.
4.2 Rule
is made absolute to the aforesaid extent.
