FACTS

:

The appellant, an advocate, sought for various information including a copy of
the enquiry report of the enquiry conducted against one Shri. V.G. Bhabasar, Chairman
of Hadity Kshetraya Gramin Bank and also against Shri Poddar, GM of the said bank.
The reason for seeking the information is to defend an official of the bank against whom
the Gramin Bank has instituted departmental enquiry has been instituted and which has
been stayed the Civil Court Kota. The appellant is the advocate for the said official. The
CPIO declined to furnish the information applying the provisions of Section 8(1)(j) of the
Act. On appeal, the AA upheld the decision of the CPIO additionally applying the
provisions of Section 8(1)(e). Hence the present appeal. Comments were called for. In
the comments, it is stated that M/S Hodity Kshetriya Gramin Bank itself is a public
authority. Central Bank is only a sponsor bank and the Chairman and directors are
appointed in consultation with NAVARD and that sponsor bank cannot take any action
towards malpractices without the approval of their boards.
DECISION:

Since the enquiry relates to officials, who are third parties, the CPIO and the AA
have rightly applied the provisions of Section 8(1)(j). Further, since the appellant seeks
the information in connection with a case in the Civil Court, he is at liberty to seek the
information through the Court. Accordingly, the appeal is dismissed.

Let a copy of this decision be sent to the appellant and CPIO.
