Rule.

Learned APP waives service of Rule.

The
applicant, convict of life imprisonment vide judgment and order dated
15th December 2001 passed in Sessions Case No.139 of 2001
by the learned Additional Sessions Judge, Godhra, has preferred this
application for grant of parole for cultivating the land during the
winter, on the ground that except his old-aged father, there is no
other person in the family to help him for farming activities, by
imposing suitable conditions.

The
jail record of the applicant produced along with this application
reveals that, by and large, the applicant has surrendered in time
whenever he was granted parole or furlough leave and, by this time,
he has undergone the sentence of about nine years.

In
the facts and circumstances of the case, the applicant is granted
parole leave for a period of 15 days from the date of his release on
furnishing personal bond of Rs.2000/- to the satisfaction of jail
authority. During the parole period, the applicant shall mark his
presence at the nearest police station twice in a week and shall
surrender to the jail authority in time on expiry of parole period.
Rule is made absolute.
