09. 14.07.2010 On repeated calls none turn up on behalf of the

appellant. Learned counsel representing the respondent was

present in first half also, but the matter was adjourned with an

expectation that some one may come to make submissions on

behalf of the appellant, but all such endeavours appears futile.

Under such circumstance, this court has left no option but to

dismiss the six years old appeal for non-prosecution.

Accordingly, this appeal stands dismissed for non-

prosecution.
