ORDER
Shri Khitish Chandra Das, the appellant has filed this appeal dated 12.4.2011
before the Commission against the Ministry of Coal, New Delhi for not providing complete
information to his RTI-request dated 7.1.2011. The matter came up for hearing on
02.09.2011. The appellant was absent, whereas the respondents were represented by
Shri P.S.S. Reddy, Director.
2. The appellant filed RTI-request dated 7.1.2011 seeking information on four queries
– (1) Please furnish the reply given by Managing Director M/s. Orissa Mining Development
Corporation, Bhubaneshwar against the show cause notice vide letter ref no. 47011/1(1)/2001-
CPAM/CA-1 dated 29.9.2010 issued by Shri V.S. Rana, Under Secretary, Ministry of Coal; (2) If
the said reply as depicted in Q. 1 was not received within 30 days from the date of issue of show
cause to Ministry of Coal, then please furnish the document related to appropriate action taken
against M/s. Orissa Mining Development Corporation for de-allocation of Utkal – D block; (3)
Please furnish the report of M/s OMC vide letter dated 18.8.2010 about the item of formation of
joint venture as illustrated in para 2 of the above show-cause notice; and (4) Please furnish
clarification given by the Ministry of Coal by its letter No. 38039/40/2007-CA-1 dated 1.4.2009.
The CPIO vide letter No. 38040/4/2011-CA-I dated 21.1.2011 requested the appellant to
deposit Rs. 8, consisting of four pages of information, pertaining Point No. 4. Information
on Point No. 1 to 3 was denied u/s 8(1) (h) of the RTI Act.

3. Aggrieved by reply of CPIO, the appellant preferred first-appeal on 18.2.2011
before FAA. The appellant has not received FAA’s order till the filing of second-appeal
before the Commission.
4. During the hearing the respondent submitted that FAA vide order No. A-60011/
20/2011-Coord dated 19.5.2011 has decided appellant’s first-appeal with the direction to
CPIO to provide information on Point No. 1 to 3 of appellant’s application dated 7.1.2011
within 15 days. In compliance with the FAA’s direction the CPIO vide letter No.
38040/4/2011-CA-I dated 13.7.2011 provided the requisite information to the appellant.
5. After hearing the respondent and on perusal of relevant documents, the
Commission observes that requisite information has been provided by the respondent to
the appellant.
The matter is accordingly disposed of at Commission’s end.
