Heard the learned counsel for the applicant, learned A.G.A. and Sri
Sanjay Kumar, Special Public Prosecutor, is also present.
It is contended by the learned counsel for the applicant that the District
Opium Officer did not express any type of suspicion either oral or in
writing at the time when the opium was weight and examined by him. In
respect of the similar case proceedings against O.P. has been stayed in
criminal misc. application no. 279 of 2008. The Special Public Prosecutor
may file counter affidavit within four weeks from today. It shall be
informed by the learned counsel for the applicant to him in writing.
Consider the submission the further proceedings of complaint case no.
13of 2006 under section 8/19 and 18/26 of N.D.P.S. Act pending in the
court of Additional Sessions Judge/F.T.C. No.1, Shahjahanpur, shall
remain stayed till the next date of listing.
