ORAL
ORDER

(Per
: HONOURABLE MR.JUSTICE BHAGWATI PRASAD)

Heard
learned counsel for the parties.

This
appeal is filed against an order of the learned Single Judge which is
in terms of the consent. The learned counsel for the appellants
submits that he has filed a review application before the learned
Single Judge disputing the consensus recorded in the order. The
review application has been dismissed.

In
view of the fact that the learned Single Judge has maintained that
there is a consensus recorded and the review application was
dismissed, we do not think that any appealable stand is available in
this appeal. In that view of the matter, the appeal is dismissed as
being not maintainable against the order passed on the consensus.

In
view of the dismissal of main appeal, no order is required to be
passed on the civil application and the same is disposed of
accordingly.

PRASAD, J.)
