Information sought:
Through number 29 RTI applications the Appellant had sought various informations related to KOD
shops and FPS Shops
PIO’s reply:
The PIO has asked for additional fees to be paid for the information.
Ground of the First Appeal:
The appellate has filed appeal for not having received satisfactory and complete information from
PIO. The specific grounds are:-
The PIO concerned has responded RTI applications according to RTI nos. which were not allotted to
the applicant from the time of his submitting the RTI till date.
The PIO has deferred his duty not to transfer RTI Application to appropriate authority.
The PIO concerned has demanded inflated amount knowingly of Rs 61,728.
Order of the FAA:
The PIO is directed to give complete information within the period of 15 days from the order of FAA.
The amount to be deposited by the appellant should be calculated realistically and he must be informed
the basis of calculation.
Ground of the Second Appeal:
The appeal is made for 41 RTI applications.
The correct, appropriate and satisfactory information is not received by the appellant despite the first
appeal. Further till date the appellant is unable to relate the information provided with his queries
because of the Id stated by the PIO but not communicated the same with reference to which query the
particular Id no. belongs.
Relevant Facts emerging during Hearing:
The following were present
Appellant: Mr. Umesh Chand;
Respondent: Mr. R. K. Meena, Public Information Officer & AC;
The appellant has filed 29 RTI applications and the PIO has tried to give the estimates of the
number of pages which could run into a few thousand pages. The PIO has now calculated the number
of pages for the 19 RTI Applications which comes to 4202 pages. The appellant states that the PIO is
providing information as per the ID numbers and he is not able to relate these with his applications.
The PIO is directed to give a list of the Appellant’s ID numbers with the receipt numbers. The
Appellant states that he is willing to pay the additional fees for 4202 pages to get the information.
Decision:
The Appeal is allowed.
The PIO is directed to provide the attested photocopies of the information sought
by the Appellant within 15 days of the Appellant depositing the additional fees of
Rs.8404/-.
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.
