                                  JUDGMENT

By Ext.P1, plot number 33 in Development Plot

Kalamassery was alloted to the petitioner for setting up an

industrial unit. On the allegation of default, the possession of the

land was resumed by Ext.P10 order. Against Ext.P10 order,

petitioner has filed Ext.P11 appeal which is pending consideration

before the 1st respondent.

2. The grievance of the petitioner is during the pendency

of the appeal steps have been taken by the 3rd respondent for

allotment of this plot to third parties. It is in this background this

writ petition has been filed.

3. Having regard to the fact that Ext.P11-appeal is

pending before the 1st respondent, I dispose of this writ petition

directing the 1st respondent to take up Ext.P11 and pass orders

thereon, as expeditiously as possible, at any rate, within eight

weeks from the production of a copy of this judgment. It is

W.P.(C) No. 7081/2008/R -2-

directed that before final orders are passed the petitioner shall be

given an opportunity to adduce his evidence. Till final orders

passed then, further proceedings pursuant to Ext.P11 will be kept

in abeyance.
