                                                       ORDER

Background

1. The Applicant filed an RTI application dt.13.1.11 with the PIO, North Western  Railway,   Jaipur 

seeking the following information:

i) Letter dt.13.5.10 issued as revised seniority list.

ii) Letter dt.8.6.10 in which name of Shri Arya Bhushan Gupta was interpolated

iii) Railway Board letter dt.16.2.10 issued to GM/NWR/JP

iv) Proposal letter of NWR/JP on the grounds of which the letter at (iii) was issued.

v) The marks obtained by all the 16 candidates in ‘Record of Service’ in Tabular format as per  

guideline of Railway Board letter dt.16.1.01 who were appeared in viva­voce on 26.5.10 and  

Shri A.B.Gupta (for AME 70% selection)

vi) Letters   of   supplementary  exams  for  calling  Shri  A.B.Gupta  and  result  of   written  exam,  

calling of Shri Gupta for viva­voce and result of viva­voce and posting orders.

Shri Subhash Rawat, PIO replied on 16.2.11 enclosing the point wise information  dt.4.2.11 

furnished by Shri Parmeshwar Sen, SPO.  Not satisfied with he reply, the   Applicant   filed   an   appeal 

dt.22.3.11 with the Appellate Authority seeking the  following information:

i) The marks obtained by the candidates in concerned selection (Gr.’B’ posts of  AME 

Regular 70%) in ‘Record of service’ in tabular format as per Railway Board letter  dt.16.1.01.

ii) The copies of referenced letters mentioned in the concerned D.O letter issued  by   Shri  

Vinay Mittal, GM/NWR/JP on 8.2.10 to Shri Praveen Kumar,  Member(Mechanical), Railway Board.  

The Appellate Authority replied on 20.4.11 providing further clarification.  Being  aggrieved with the 

reply, the Applicant filed a second appeal dt.10.5.11 before CIC  stating   that   the   Appellate   Authority   had 
denied the information against point (i) of the first appeal u/s 8(1)(j) and against point (ii) has provided one 

more copy of the D.O  instead of providing copies of referenced letters mentioned in that D.O.

Decision

2. During the hearing, the Respondents submitted that overall marks received by each candidate as well 

as the Appellant’s own marks and gradings have been provided for to the Appellant with regard to the 

selection of Group B post of AME Regular 70%.  The Appellant at this stage sought gradings in the 

ACRs of all the candidates so that he can compare his own gradings with theirs.

3. The Commission on careful consideration of the request of the Appellant denies the disclosure as the 

same as it relates to personal information, the disclosure of which has no relationship to any larger 

public activity/interest and which cause unwarranted invasion of privacy of those individuals.     The 

reference letters as mentioned in the D.O were provided to the Appellant in the presence of the 

undersigned.

4. The Appeal is rejected and the case closed at the Commission’s end.
