RULE.

Learned APP Mr.L.B.Dabhi waives service of rule on behalf of the
respondent State.

This application is
filed by the applicant appellant in Criminal Appeal No.1901/2005
for fixing early date of hearing of the Criminal Appeal on the
ground that the applicant appellant is in Jail since last five
years.

Learned advocate Mr
Mitesh Rangras for the applicant appellant was heard in detail.

It appears that still
paper book has not been received from the trial Court, though it has
been volunteered by the learned advocate for the applicant
appellant that he would supply the paper book, but that would not
serve the purpose. However, Registry is directed to call for paper
book from the trial Court and to notify Criminal Appeal No.1901/2005
on final hearing board without affecting the seniority of all other
matters filed earlier to this appeal.

To this extent, this
application is partly allowed. Rule is made absolute to the above
extent.
