                            ORDER

Nobody appears for the petitioner even in second

round. I have gone through the merits of the matter also, and

find that by this petition the petitioner has sought to

challenge the selection process i.e. has challenged the

qualification prescribed for the post advertised. The

advertisement was issued way back in the year 1995, and notice

of stay was issued, and after hearing all that was ordered was

that the selection shall be subject to the result of writ

petition. The fact does remain that the petitioner was also

interviewed but was not selected. From the affidavit filed in

support of the writ petition, I find that the age of the

petitioner Narendra Kumar was 50 years in the year 1996.

Obviously with the result that by now he has crossed the age

of superannuation also. In that view of the matter, otherwise

also writ becomes only academic.

It is again a different story that on the last dates

of hearing being 17.3.2009, 17.12.2008, 7.11.2008, 26.5.2008,

15.5.2008, 7.5.2008 etc. also nobody had appeared, and on some

of the intervening hearings being 18.11.2008 and 29.5.2008

when the counsel appeared he only sought adjournment.

It appears that in view of the facts noticed above

the petitioner is not seriously interested in pursuing the

matter as well.

In that view of the matter, the cumulative result is

that the petition is dismissed.
