Facts

By an application dated 20.04.2009 Shri Ranjit Singh Chauhan of Mandi,
Himachal Pradesh sought information from the Central Public Information Officer,
Directorate General, ITBP, New Delhi, regarding reason for non-settlement of
pension case of one Shri Puran Chand, Ex. Constable/GD No. 770040087 of the
Force, who had been discharged from service on medical grounds, together with
copies of concerned documents including copies of noting regarding the case
file. In response, CPIO Shri Shyam Mehrotra, Deputy Inspector General (Admn.)
ITBP, by a letter dated 29.04.2009 transferred the application of the complainant
to Dy. Director (Medical), Directorate General, ITBP, R. K. Puram, New Delhi as
the subject matter was pertaining to that wing. Finally a response dated
10.06.2009 was received by the complainant from Dy. Director, & CMO (SG),
Dte. Gen. ITBP, New Delhi in which information had been denied in light of
Section 24 read with Second Schedule of RTI Act. The complainant, being
aggrieved, has the approached this Commission.
Decision Notice
The Indo-Tibetan Border Police (ITBP) is indeed an organization listed at
S, No. 11 in the Second Schedule of Right to Information Act, 2005 as dealing
with security and intelligence, and therefore not covered by the Act except for
information pertaining to the allegation of corruption and violation of human
rights. The information sought by the complainant Shri Ranjeet has made no
such allegations. The information sought by the complainant is general

information which concerns the pension of an individual and is related to
administrative issue of personnel management, and hence, does not lie under
the ambit of RTI Act. In light of the above the present complainant is hereby
dismissed.
Announced this twenty-sixth day of February, 2010. Notice of this decision
be given free of cost to the parties.
