Heard the learned counsel for the petitioners and the learned
Standing Counsel.
Petitioners are aggrieved by the order of suspension dated
12.5.2010 pending inquiry. The contention of the petitioners is that
the charges levelled against them are not such which can lead to
the major punishment like termination, dismissal or removal,
therefore, the order of suspension is not warranted.
I have considered the submissions made on behalf of the
petitioners and perused the record. As it is a case of suspension
pending inquiry and normally this Court does not interfere in the
order of suspension being suspension no punishment, therefore, in
my opinion, the contention and the submission of the petitioners
can only be considered during the disciplinary proceeding, as such
in my opinion, it will be appropriate that the writ petition may be
disposed of finally directing the disciplinary authorty to complete
the disciplinary proceeding within a period of three months after
affording full opportunity to the petitoner in case they cooperate in
the inquiry.
The writ petition is disposed of accordingly.
No order is passed as to costs.
