Facts

By an application dated 21.07.2008 Shri R. Nandhakumar of Salem, Tamil
Nadu sought information from the Central Public Information Officer, Central
Reserve Police Force, Gandhi Nagar, Gujarat regarding date of joining of one
Ms. G. Mahalakshmi, the quota under which she had been appointed, together
with information regarding her nominees/legal heirs and the date from which she
was working with one Ms. Anitha of Kerala. In his response dated 12.11.2008,
the CPIO, CRPF, Gandhi Nagar, Gujarat provided point-wise information to the
complainant. The complainant has moved this complaint before us alleging that
the CPIO has provided incorrect information to him.
Admitting the complaint of Shri R. Nandhakumar u/s 18(1)(e) of the Act
the Commission served notice on CPIO, CRPF, Gujarat on 23.03.2010 for
furnishing comments on the complaint. No comment has been received from the
CPIO.
Decision Notice
It is pertinent to mention here that the Central Reserve Police Force is an
organization listed at S. No. 10 in the Second Schedule of Right to Information
Act, 2005 as dealing with security and intelligence, and therefore not covered by
the Act except for information pertaining to the allegation of Corruption and
Violation of Human Rights. The information sought by the complainant Shri R.
Nandhakumar has made no such allegations. The information sought by the
complainant concerns the appointment of one Smt. G. Mahalakshmi and her
nominees and thus is general information, concerning a third party. Hence,
particularly in light of Sec 24(1) the application does not lie under the ambit of
RTI Act. The CPIO is thus free to provide such information as whatever he
deems fit under rules. This Commission has no jurisdictionto adjudicate on the
matter. In light of this the present complaint is hereby dismissed.
Announced in open chamber on this twentieth day of April, 2010. Notice of
this decision be given free of cost to the parties.
