This substitution application is within time. The
appellant No.3 died on 7.8.2010 and the petition has
been filed on 30th August 2010. The legal
representatives of the deceased appellant No.3 namely
Madan Singh be substituted in place of appellant No.3.
He has already appeared by filing vakalatnama.
The learned counsel for the appellants
submitted that this appeal is of the year 1977 and,
therefore, the appeal may be heard finally without
paper book. No objection is raised on behalf of the
respondents.
If the appeal is ready otherwise without the
paper book, the office may list this first appeal under
the heading ‘For hearing’ after Durga Pooja holiday.
