Heard learned counsel for the parties.

From the perusal of the averments made in the affidavit accompanying the
recall application as well as the order sought to be recalled and the material
brought on record it is apparent that the order dated 28.04.2010 was passed
without hearing the applicant.

Cause shown in the affidavit accompanying the recall application for non-
appearance is sufficient.

The recall- application is allowed.

The order dated 28.04.2010 is recalled.
