As scheduled, the hearing was resumed on 23/04/2009. Shri Bhutia submits a copy of
the report prepared by the Board of Inquiry and Hearing before the Commission which is
taken on record and a copy thereof handed over to Ms. Verma. As regards the two other
GD Verma 23 04 2documents mentioned in para 1 of the Interim Decision under reference, Shri Bhutia
agrees to give copies thereof to Ms. Verma for perusal. Shri Bhutia also furnishes a
copy of his comments on the representation made by Ms. Verma on 15/04/2009 which is
also taken on record and a copy handed over to Ms. Verma. Ms. Verma expresses her
dissatisfaction on the comments of Shri Chandu Bhutia. Her submissions in this regard
andthe response of Shri Bhutia in regard thereto are given below :(i) As regards point ‘A’ of the RTI application, Ms. Verma draws my
attention to para 2.0 (b) of the Resolution as per which adequate provision
for the housing of all income groups, especially for EWS and LIG is
required to be made. It is her say that in the affidavit filed by
Commissioner (Plg.) does not clearly state whether specific provision has
been made for EWS and LIG families and that only a broad submission
has been made therein to the effect that the development of residential area
is expected to provide dwellings for about 4.5 lac families of all income
groups.To this, Shri Bhutia would respond that it was only an observation
of the Board which is not binding on DDA and that it is for DDA to accept
the recommendation of the Board or not.(ii) As regards point ‘B’ of the RTI application, Ms. Verma would submit that
her query has not been specifically answered inasmuch she is interested in
knowing whether DDA has specifically formulated any specific scheme
for the housing of Rangpuri residents but no categorical reply has been
given in this regard
On the other hand, Shri Bhutia would submit that on page 2 of the
affidavit of Commissioner(Plg.) it has been mentioned that Zonal
Development Plan is a policy document and it is not area or locality
specific.Be it as it may, it appears to me that the query raised by the Appellant has not
been specifically responded to. Hence, Shri Bhutia is directed to further check up the
position with the concerned Departments of DDA and categorically inform the Appellant
whether any specific housing scheme for the Rangpuri residents has been formulated by
the DDA and if any such scheme has been formulated, broad details thereof may be
provided to the Appellant.(iii) As regards point ‘C’ of the RTI application, it is her say that the
Appellants had requested for category-wise information regarding the
construction of flats etc. in and around Vasant Kunj area viz. HIG, MIG,
LIG, EWS etc. but this information has not been provided. It is also her
say that in the affidavit filed by Commissioner(Plg.), 805 flats have been
shown to be under construction, having 02 rooms + lounge and she wants
to know whether they fall in LIG category or any other category. She has
also raised a query as to on what basis 340 flats near Sultan garhi have
been shown as LIG category when the brochure on the said Scheme does
not show them as such.GD Verma 23 04 3
Shri Bhutia is hereby directed to take necessary steps to collect thte
above information from the quarters concerned and provide to the
appellant.(iv) As regards point ‘D’ of the RTI application, it is her say that no additional
information has been given other than that which is contained in the
affidavit filed by Commissioner (Plg.). She is interested in knowing the
details of allotments made to LIG/EWS families.To this, Shri Bhutia would respond that 324 LIG flats were
constructed and the same stand allotted.Ms. Verma, however, is not satisfied with this inasmuch as she
wants to know as to how many of these flats have been allotted to
‘LIG/EWS families’. It is also her say that as per her information, EWS
flats have also been constructed in the said area but no information has
been provided regarding the allotment of these flats to EWS families.Shri Bhutia is hereby directed to take up the matter with the
Housing Department or, for that matter, any other concerned Department
of DDA to ascertain whether such information is being maintained and, if
yes, to provide the same to the Appellant.DECISION
3. In view of the above discussion, Shri Chandu Bhutia (CPIO) is hereby directed to
provide information as indicated herein above to the Appellant in three weeks time.4. The matter is adjourned to 8.6.2009 at 1200 hrs for further hearing on the issue of
compliance of above directions.Sd/-
