Heard learned counsel for the applicants and learned AGA.
This application has been filed with a prayer to quash the charge sheet under
Sections 363, 366, 376 IPC, P.S. Ramgarh, district Firozabad pending in the
Court of Civil Judge (J.D) Second, Shikohabad, district Firozabad in criminal
case no.1891 of 2010.
It is contended by learned counsel for the applicants that in this case,
statement of prosecutrix has been recorded under Section 164 Cr.P.C. She has
not supported the prosecution story. She is living in the company of applicant
no.1 as his wife. In these circumstances the proceedings pending against the
applicants may be quashed.
Considering the submission made by learned counsel for the applicants that
the applicant no.1 has been released on bail, it is directed that in case he
moves discharge application before the Court concerned, the same shall be
heard and disposed of expeditiously in accordance with law.
With the aforesaid directions, this application is finally disposed of.
