Hon'ble Vikram Nath,J.

Heard Sri B.N. Chaturvedi, learned counsel for the applicant and Sri B.P.
Singh, learned counsel for the opposite parties.

In the affidavit filed in support of the recall application filed by the opposite
parties it has been stated that whatever amount was due to the applicant under
the judgment of the Writ Court has already been paid to the applicant in the
month of January, 2010. As such the order passed on 6.7.2010 be modified to
the extent that the personal appearance of the opposite parties be exempted for
20.7.2010.

Sri Chaturvedi, learned counsel appearing for the applicant prayed for that the
matter may be heard as the opposite parties have not made full compliance of
the directions of the Writ Court and the amount of arrears calculated by the
opposite parties is faulty. As 20.7.2010 is the date fixed, the matter may be
heard on the said date.

In view of the averments contained in the affidavit filed along with the recall
application, it is provided that the personal appearance of the officers
mentioned in the order dated 6.7.2010 would not be necessary on 20.7.2010,
however, the matter will proceed as per order dated 6.7.2010.

Order Date :- 19.7.2010
