05. 12.07.2010 This is an application for restoration of S.A.
No.110 of 2003, which stood rejected due to non-
compliance of the peremptory order 18.08.2005,
which directed for removal of three defects as
indicated in this Court’s order dated 10.09.2003 with
a rider that if defects were not removed within a
fortnight the S.A. will stand rejected without further
reference to a Bench.
Upon hearing the learned counsel for the
petitioner/appellant and on consideration of the
grounds as set forth in the application this restoration
application is allowed with a condition precedent that
the petitioner/appellant will deposit a sum of
Rs.450/- in the Patna High Court Legal Aid Services
Committee within ten days from today and the
peremptory order dated 18.08.2005 as in the said
S.A. No.110 of 2003 will also be complied within ten
days from today. It is hereby clarified that the

deposit of the amount with the Patna High Court
Legal Services Committee and the compliance of the
said peremptory order dated 18.08.2005 are condition
precedent for the restoration of S.A. No. 110 of 2003
and non-compliance of any of the two pre-condition
will entail the withdrawal of this order of restoration.
This restoration application is allowed with
the condition cited above.
