application made under section 5 of the Limitation Act has been taken
out by the applicant State Government for condonation of delay of 179
days caused in filing the above Letters Patent Appeal.

the facts and in the circumstances of the case, the delay caused in
filing the appeal is condoned. Rule is made absolute in terms of
paragraph 5(B) of the application. The parties shall bear their own
costs.
