It
is stated by Mr. PR Abichandani, Ld. AGP on the instructions received
from Mr. AM Shah, Deputy Executive Engineer, who is present in the
Court that payment in accordance with the provisions of section 17-B
of the Industrial Disputes Act has been made upto the period June
2005 and the amount for July and August, 2005 will be paid on or
before 20th September, 2005.

In
view of the above, it appears to us that the compliance is
substantially made and there is no need to initiate proceedings
against the opponents under the provisions of the Contempt of Courts
Act. Ofcourse it was suggested to the Ld. AGP by the Court that
instead of making idle payment to the applicants, they should be
absorbed in employment in the Government any where and to provide
them work. In response to the same, it is stated before us that the
project on which the applicants were working is already over.
However, possibility to absorb them in the work projects in nearby
areas will be shortly explored and if found feasible, they will be
suitably absorbed in the employment.

In
view of the aforesaid, these applications are disposed of. Notice
discharged.
