Heard Sri Amit Bose, learned counsel for the petitioner and learned
Standing Counsel.
With the consent of learned counsel for the parties, the writ petition is
being disposed of finally.
By means of the instant writ petition, the petitioner has assailed the
order of transfer dated 23.8.2007 passed by the State Police Motor
Vehicles Officer, Lucknow, whereby he has been transferred on the post
of Constable (Technical) Carpenter from Regional Police Motor
Transport Workshop, Lucknow to the Regional Policy Motor Transport
Workshop, Agra.
Learned counsel for the petitioner submits that while entertaining the
writ petition, this Court, vide order dated 1.9.2007, has been pleased to
stay the operation and implementation of the order dated 23.8.2007 as
contained in Annexure 1 to the writ petition and in compliance thereof,
the petitioner had worked at Regional Police Motor Transport Workshop,
Lucknow till date. He submits that he does not want to press the relief
claimed in the instant writ petition, but restricts his prayer only to the
extent that the opposite parties may be restrained from relieving the
petitioner in pursuance to the order of transfer dated 23.8.2007 till the
end of this academic year i.e. 31.3.2010 from the present place of
posting, to which learned Standing Counsel has no objection.
In view of the above, without entering into the merits of the case, the writ
petition is disposed of finally with a direction to the opposite parties not
to transfer the petitioner till the end of this academic year i.e. 31.3.2010.
However, it will be open for the opposite parties to pass appropriate
transfer order in accordance with law after 31.3.2010, if they so desire.
