Learned
Advocate Mr. H.R. Prajapati for the appellants submits that he
has instructions from his clients appellants that the matter
has been settled out of court and, therefore, according to further
instruction, learned Advocate for the appellants seeks permission to
withdrawal this Appeal as well as Civil Application filed for the
interim orders. Learned Advocate Mr. Dilip Kanojia for learned
Senior Counsel Mr. R.S. Sanjanwala for respondent No.5 is present. He
has no objection to the withdrawal of the Appeal.
Permission
is granted as prayed for.
In
view of above, First Appeal No. 3010 of 2008 as well as Civil
Application No. 8067 of 2008, both stands disposed of as withdrawn.
Court fee refund, if any, is entitled to the appellants, be
refunded to the learned Advocate for the appellants, according to
law.
