Prayer: Original Application No.1379 of 2001 filed before the Tamil Nadu Administrative Tribunal, on abolition, transferred to the file of this Court and renumbered as Writ Petition No.2325 of 2007, seeking for a writ of Certiorarified Mandamus, to call for the records in pursuant to the Impugned Order passed by the 1st Respondent in G.O.Ms.No.120 Highways (HR 1) Department dated 20.05.98 and quash the same and to direct the respondents to allow the Applicant to retire from service with effect from 30.04.92 by regulating the leave period as duty and consequently grant all terminal and pensionary benefits with interest.

O R D E R

Since the learned counsel appearing on behalf of the petitioner had submitted that he had given a change of Vakalath, on 24.10.2008, the Registry was directed to verify if any fresh vakalath has been filed on behalf of the petitioner. Since no fresh vakalath had been filed on behalf of the petitioner, the name of the petitioner had been printed in the cause list. When the matter was taken up for hearing, on 04.08.2009, there was no representation on behalf of the petitioner. Therefore, the matter was posted under the caption “for dismissal”. Even today, there is no representation on behalf of the petitioner. Hence, this petition is dismissed for non-prosecution. No costs.
