Patna High Court – Orders
Devendra Prasad vs State Of Bihar &Amp; Anr on 9 February, 2011
IN THE HIGH COURT OF JUDICATURE AT PATNA
                                 Cr.Misc. No.22462 of 2010
DEVENDRA PRASAD SON OF LATE SITARAM PRASAD, RESIDENT OF
VILLAGE DHAMNA, P.SW. JHAJHA, DISTRICT JAMUI ..... PETITIONER
                                              Versus
           1. THE STATE OF BIHAR
           2. BANARSI PRASAD RAWAT SON OF LATE KISHORI PRASAD RAWAT,
RESIDENT OF VILLAGE DHAMNA, P.S. JHAJHA, DISTRICT JAMUI
                                                           .... OPP. PARTIES
                                            -----------

2. 9.2.2011 The petitioner seeks quashing of the orders dated

4.3.2010 and 18.5.2010 passed in Sessions Trial No.313

of 2008, by which the Additional Sessions Judge 1st, Jamui

has rejected an application filed u/ss.227 and 228 Cr.P.C.

It has been submitted that on account of the order

of this court passed in Cr.Mic.No.32984 of 2007 the trial

court appears to be somewhat under pressure and,

therefore, did not consider the merits of the case while

passing the order impugned.

In my view, the court below has taken into

consideration the entire aspects of the matter and

thereafter disallowed the prayer of the petitioner and,

therefore, I find no merit in the present application. The

same is dismissed.

However, the trial court will not be unnecessarily

influenced by these orders at the stage of trial.
