J U D G M E N T
The learned Government Pleader has now placed before me
a Government Order No. G.O.(RT) No. 2822/2009/G.Edn.
dated 19.6.2008 which reads thus:
“As per the Judgment of the Hon’ble High Court read
as 1st paper above, the Court was directed Government to
regularise the service of the petitioners in W.P.(C)
No.18179/2007. Government have already moved in the
Supreme Court against the above Judgment dated
18.9.2007 in W.P.(C) No. 18179/2007 in SLP(C) CC with
Diary No. 16241/2008 and the same is pending before the
Supreme Court.
2. The petitioners in W.P.(C) No. 18179/2007 have
filed CC(C) No. 429/2008 before the Hon’ble High Court
alleging non-compliance of Judgment dated: 18.09.2007 and
the Court has ordered to comply the Judgment on or before
23.06.2008 otherwise appearance in person by the 1st
respondent is ordered.
3. In view of the circumstances stated above,
Government are pleased to approve the service of Shri.
Sebastian Mathew, Shri. Joshy Joseph and Shri. Vinod
Kumar. K. – the petitioners in W.P.(C) No. 18179/2007 with
all consequential benefits subject to the Judgment in the
Special Leave Petition pending before the Supreme Court in
this regard and also subject to the condition that the
approval of the above teachers will be terminated without
further notice if the Special Leave Petition is ordered in
favour of the Government.”
Contempt Case No.429 of 2008 – 2 –
In view of the said Government Order, no further
orders are necessary in this Contempt Case. Accordingly,
this Contempt Case is closed.
