ORAL ORDER
(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)
This
so-called public interest litigation has been preferred by the
petitioner on the ground of certain irregularities committed in
Gujarat Vidhyapith.
2. The
learned counsel for the petitioner submits that there are various
irregularities being committed such as (i) the Vice-Chancellor has
not been appointed in accordance with law, (ii) a number of teaching
staff have been appointed, who are not qualified and salaries are
paid, and there are other irregularities. However, as we find that
the irregularity of one or other has been shown which relates to
service matter and in such case no public interest is involved, we
are not inclined to issue any writ in the present case. However,
this order shall not stand in the way of the petitioner to bring the
matter to the notice of the Chancellor of the University, who may
look into the matter and pass appropriate orders. If any application
has already been preferred by the petitioner, the petitioner may
bring the same to the notice of the Chancellor alongwith a copy of
this order.
This
writ petition stands disposed of. No costs.
