Heard
Mr.Sanjay D. Suthar, learned advocate for Mr.N.K.Majmudar, learned
counsel for the petitioner. It is submitted by him that the
petitioner was appointed as Class-IV employee in the year 1994 and
his services were terminated on 12.12.1997, as he was found to be
medically unfit. The petitioner challenged his termination by filing
Special Civil Application No.292/1998 wherein, by order dated
22.6.2007 the respondent was directed to produce the petitioner
before a Panel of Doctors. The learned counsel for the petitioner
further submits that the petitioner was examined by the Panel of
Doctors and was found to be medically fit, therefore, his name was
again included in the list of Class-IV employees, and he was given
appointment. However, the petitioner has not been given continuity of
service for the period between 15.12.1997 to 21.11.2007, and he is
being treated as though he is a fresh appointee.
Notice
returnable on 24.1.2011.
In
addition to the normal mode of service, Direct Service is also
permitted.
