Heard learned counsel for the applicant and the learned A.G.A. and perused
the record.

It is contended by the learned counsel for the applicant that according to the
F.I.R. the co-accused Rajendra Prasad Singh is the main accused. The main
allegation of misappropriation of money has been made against him. It is
alleged that the applicant was his associate.The applicant and Rajendra Prasad
Singh was posted at the Branch of District Co-operative Bank, Ballia. The
applicant was transferred from the Branch concerned to Belthera Road on
19.9.1989. The allegation of misappropriation is of the year 1990-91. He was
having no concern with the above mentioned misappropriation of money. The
case of the applicant is distinguishable with the case of Rajendra Prasad
Singh. The applicant is in jail since 30.4.2010.

In view of the facts and circumstances of the case and submissions made by
the learned counsel for the applicant and without expressing any opinion on
the merits of the case the applicant is entitled to be released on bail.

Let the applicant Abdul Sattar involved in case crime no. 27 of 2009 under
Sections419,420,409,467,468,471,204,201 I.P.C.,P.S. Umanv District Ballia
be released on bail on his furnishing a personal bond and two heavy sureties
to the satisfaction of the Court concerned with the condition.

• That the applicant shall not tamper with the evidence.

• That he shall report to the court of C.J.M. concerned in the first week
of each month to show his good conduct and behaviour till conclusion
of the trial.

In case of default in any of the above mentioned conditions, the bail granted
to the applicant shall be deemed cancelled and he shall be taken into custody
forthwith.
