Challenging the approval of allotment of Plot No.289 M (Pond) area 0.506
Hectare at Rs.5000/- per annum for a period of 10 years, the present writ
petition has been filed.
The submission is that the said allotment was made in favour of respondent
No. 4 without any advertisement etc. By means of the supplementary
affidavit, the petitioner has stated that he is prepared to pay a sum of
Rs.7000/- per annum if the said pond is allotted to him.
Notices on behalf of respondent Nos. 1 to 3 have been accepted by the learned
standing counsel.
Issue notice to respondent no. 4.
The effect and operation of the approval order dated 10.3.2010 passed by the
Sub Divisional Magistrate, shall remain stayed. In case the respondent no. 4
files an affidavit showing his willingness to pay the rent at Rs.7000/- per
annum and also deposits the balance amount amounting to Rs.2000/- within a
period of two weeks, the stay order shall come to an end.
