3 12.10.2010 Appellants Shyam Sundar Raut, Ram Prasad Raut
and Ashok Raut all three are alleged to have assaulted on
the head of the deceased with iron rod and Khanti.
Counsel for the appellants submits that the doctor
who has conducted the post mortem on the deceased was
examined as P.W.13. His evidence was not specific as to
which of the injuries caused by which of the appellants is
fatal and also that a general and omnibus allegation has
been made against all three accused. Ashok Raut has
already been granted bail by this court. The case of these
appellants is also on similar footing.
Considering this fact, prayer for bail on behalf of
above named appellants, namely, Ram Prasad Raut and
Shyam Sundar Raut is allowed. Let above-named
appellants be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) each with two sureties of the
like amount each to the satisfaction of the Additional

Sessions Judge, FTC No.I, Madhubani in Sessions Trial
No. 114 of 2004 arising out of Andhratharhi P.S. case No.
73 of 2003.
Realization of fine shall remain stayed.
