Background
1. The applicant filed an RTI application dt.29.1.08 with the CPIO, DoP,
Gurgaon. He requested for information regarding marks obtained by the
candidates who appeared in the Postman Exam 2005 held on 7.10.08 and
the selection process thereof. The CPIO replied on 25.2.08 denying the
information as it relates to a third party. Not satisfied with the reply, the
Applicant filed an appeal dt.28.9.08 with the Appellate Authority. The
Appellate Authority replied on 28.11.08 denying the information u/s 8(1)(e).
Aggrieved with the reply, the Applicant filed a second appeal dt.27.3.09
before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 9, 2009.
3. Mr. Sushil Kumar, D.P.S, Gurgaon cum Appellate Authority and Mr. S.K.
Bhardwaj, ASPO(HQ) represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that CIC Order No.CIC/AD/A/09/00422 dated
30.4.2009 has been complied with as information has been provided vide
letter dated 26.5.09. The Commission noted that this is the same RTI
request as the one disposed of earlier on 30.4.09 and since the information
has already been provided, accordingly disposes of the appeal.
