On 17.9.2008, following order was passed:-

“Learned counsel for the petitioner says that the
petitioner will be depositing the outstanding amount
alongwith upto date interest before the next date,
failing which, this petition will stand dismissed.

Notice of motion to respondent No.2 for
3.10.2008.

Dasti only.

In the meanwhile, if sale has not been
confirmed, the same may not be confirmed till the next
date.”

Learned counsel for the respondent-Bank states that

the petitioner failed to comply with the undertaking given to this

Court and did not make any deposit.

Learned counsel for the petitioner says that he has

been conveyed a wrong date.

On the last date also, counsel for the petitioner sought

adjournment.

In view of statement made on behalf of the

respondent-Bank that the petitioner has failed to make any

deposit, this petition is dismissed.
