Facts
:
1. The appellant was heard today, i.e. 6th May, 2009.
2. In the course of hearing, the appellant alleged irregularities in allotment of
dealership to an applicant who is identified in his application. He stated that the
person who was allotted dealership has shown different amounts of deposit in his
account at the time of application for distributorship and interviews, which is
illegal. This is also accepted by the respondent, even then, he alleged, the
dealership has been awarded. He therefore pleaded for providing access to the
documents submitted at the time of application for dealership and the interviews.
He also alleged that the respondent had identified the deficiency in the
submission of documents, yet the dealership was allotted to the person, who
furnished the mis-leading information to the respondent. The appellant presented
the relevant documents to prove his points.
Decision:
3. The appellant is already in possession of the documents which shows that
the awardee of dealership had indicated different sums of money deposits in his
account at the time of application for dealership and at the time of interviews. The
respondent has replied that such act by any applicant constitute violation of
guidelines since an applicant is expected to reveal the same amount of deposit
on both the occasions, as mentioned above.
4. In view of the above, the CPIO is directed to allow the appellant to inspect
the relevant documents submitted by the awardee of dealership in question so as

to enable him to verify the facts as to whether or not there has been violation of
the guidelines by the respondent.
5. Needless to mention, a public authority u/s 4 (1) (b) (xiii) of the Act is
expected to disclosed particulars of the recipient of concession, permits or
authorization granted by it. Since, the dealership, in question, has been awarded
by allowing concessions in the physically handicapped category, the CPIO
should provide access of all the necessary documents on the basis of which
dealership has been awarded.
6. Both the parties should mutually decide a convenient date and time for
inspection of relevant documents within one month from the date of issue of this
decision. The identified documents should be provided as per the provisions of
the Act.
7. The appeal is thus disposed of.
