Facts

:­ 

1. Through  his  RTI  application  of  29.9.2009  Shri  Shivkant  H.  Jaiswal 
sought information from the CPIO, The New India Assurance Co. Ltd. Nagpur 
through   10   points   pertaining   to   the   rejection   of   his   mediclaim   proposal 
preferred against Mediclaim No. LIC/MEDI/09­10/212.

2. Shri Jaiswal preferred complaint before the Commission. The matter 
was heard today through video conferencing. Respondent was present as 
above. Applicant did not appear. 

3. Respondent stated that they had obtained a copy of the policy order 
their Mumbai Office and provided the same to the applicant under cover of 
their   letter   dated   25.11.2009.   Respondent     sought   waiver   of   penalty   on 
account of delay since they were not holder of the information and it had 
taken time to obtain the same.

Decision

4. Commission   is   satisfied   by   the   efforts   made   by   the   respondent   in 
obtaining copy of the policy which clarifies all the provisions and conditions to 
the appellant, however, Commission observes that  respondent     has   not 
provided  point­wise information to the appellant.  They are directed to do so 
within one week of receipt of the order.  Commission accepts the explanation 
of the respondent as credible and drops penalty proceedings with warning to 
be more careful in future in handling RTI applications.
