ORDER

The
grievance which is voiced in the present petition is with respect to
not mutating name of the petitioner in the revenue record. Shri
Majmudar, learned advocate appearing on behalf of the petitioner has
submitted that Mamlatdar & ALT is not mutating the name of the
petitioner and is insisting for no objection from the concerned
private respondents herein in whose names the mutation entry is
continued/made. If the Mamlatdar & ALT is not mutating the name
of the petitioner in the revenue record, the appropriate remedy
available to the petitioner is to prefer the Appeal before the Deputy
Collector/Collector as non-mutating the name of the petitioner in the
revenue record shall be considered as an order which is appealable.
Hence, present petition is not entertained. As and when such Appeal
is preferred, the appropriate Appellate Authority is directed to
consider the same in accordance with law and on merits at the
earliest.
