Instead of Mr. Tapas Roy, A.P.P, Mr. Sarju Mahto, A.P.P, will
assist this case.

Heard learned senior counsel appearing for the
petitioner, Mr. P.C. Tripathy and learned counsel for the State Mr.
Sarju Mahto.

The petitioner is apprehending his arrest in connection
with the case registered under Sections 376 of the Indian Penal
Code.

Learned counsel for the petitioner submits that the
petitioner and informant has compromised the matter out side the
Court and also filed a compromise petition before the Court below
and the same has come in the impugned order also.

Learned counsel for the State opposed but not
disputed the aforesaid contentions made by the counsel for the
petitioner.

Considering the fact that the parties have already
compromised the matter only for granting of bail, I direct the
petitioner, above named, to surrender in the court below within a
period of one month from the date of this order i.e. 22.09.2011
and in the event of his surrender, the trial Court is directed to
release him on bail, on furnishing bail bond of Rs. 10,000/- (Rs.
Ten thousand) with two sureties of like amount each to the
satisfaction of C.J.M, Daltonganj at Palamau in connection with
Rehla P.S. Case No. 24 of 2011, subject to the condition that one
of the bailors will be his close relative and another will be of local
resident having immovable property within the jurisdiction of the
trial court and also subject to the conditions laid down under
Section 438(2) of the Cr.P.C.
