ORAL ORDER
Pursuant
to the order dated 8th August, 2008, Mr.A.D.Suthar,
Auditor, Grade-I, is present from the office of the Commissioner of
Schools. Besides, there are other officers present from the office
of the District Education Officer viz. Mr.H.H.Rajguru, Education
Inspector and Mr. D.H.Gajjar, Assistant Education Inspector. There
is no order asking any person to remain present from the office of
the District Education Officer.
It
is understandable that the District Education Officer could have
deputed one officer i.e. Education Inspector. The Assistant
Education Inspector Mr.D.H.Gajjar, present in the Court, is not able
to explain as to why is he here. He submits that he is directed by
the District Education Officer to accompany Education Inspector for
requesting the Court for time. This reason is strange.
The
Assistant Education Inspector is directed to apply for leave report
for today and not to claim TA/DA for being present in the Court
today.
The
District Education Officer shall remain present personally before
the Court on 14th August, 2008, sharp at 11:00 a.m.
The
Education Inspector when confronted with order dated 14.07.2008
granting approval to the petitioner’s school and when asked as to
why this letter is taken back from the petitioner, he submits that
the said letter/approval was suspended (?SSthagit??)
by letter dated 30.07.2008 as the matter was under consideration of
the Vigilance Commission. The Education Inspector was asked to
point out a single word in order dated 30.07.2008 mentioning about
the suspension of the approval granted by letter dated 14.07.2008.
Despite his sincere exercise to find out the same, he was not able
to point out anything from the order dated 30.07.2008.

copy of this order be made available to Ms.Calla, learned Assistant
Government Pleader for its onward communication and compliance.
