Background
1. The RTI application was filed on 18.09.08 by Mr.Rajeswar Mukul requesting for mark
list for the year 2000-01, 2002-03 and 2003-04 along with rules. He also requested
for certified copy of cover page of his own answer sheet for the year 2003-04. The
information was provided on 29.9.08 by the CPIO. Again an appeal was filed by Mr.
Rajeswar Mukul on 10.11.08 requesting for copies of answer sheet of 4 candidates.
The CPIO replied on 04.12.08 to the Complainant informing him that answer sheets
of other candidate are exempted from disclosure under Section 8(1)(j) of the RTI Act,
2005 since they are personal information. Being aggrieved with the reply, the
Applicant filed a Complaint before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing for 14th December, 2009.
3. Mr. Shashi Kant Pandey, Dy. Director (AT) & CPIO represented the Public Authority.
4. Efforts were made to contact the Complainant over phone but contact could not be
established because of faulty telephone line.
Decision
5. On hearing both sides, the Commission denies disclosure of answer sheets of other
candidates to the Complainant as the same are personal information, disclosure of
which has no relation to any public activity or interest. The complaint is accordingly
disposed off.
