Facts

arising from the Complaint:

Mr. Subhash Chandra Agrawal had filed a RTI application with the PIO- MCD,
O/o Municipal Secretary, Town hall, Delhi on 27/06/2009 asking for certain information.
Since no reply was received within the mandated time of 30 days, he had filed a
complaint under Section 18 to the Commission on 01/07/2009.

The Commission issued a notice to the PIO on 04/07/2009 asking him to supply
the information by 29/07/2009 and sought an explanation for not furnishing the
information within the mandated time. The PIO has informed the Commission vide a
letter dated 07/08/2009 that the reply of the RTI Application dated 27/06/2009 has been
sent to the Complainant. In response to Query no. 5 of the RTI Application dated
27/06/2009 PIO had stated that the letters had been sent to the concerned staff to give
consent to disclose their pay etc. being third party information, after receiving their
consent the reply would be sent. The PIO has further informed the Commission vide a
letter dated 08/09/2009 that the reply of Query no.5 of the RTI Application dated
27/06/2009 has been sent to the Complainant.

Decision:

The Complaint is disposed off.

The Commission warns the PIO to ensure that information is given to applicants
within 30 days as mandated under Section 7 (1) of the RTI Act, 2005.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act,
2005.
