02 25.11.2010 Heard learned counsel for the petitioner as well as

learned P.P. for the State.

Petitioner is husband of the complainant’s daughter

whose marriage had taken place 12 years ago with petitioner but

subsequently petitioner had started torturing the complainant’s

daughter on account of non-fulfilment of illegal demand and

solemnized his second marriage with one Anita Devi.

Although learned counsel for the petitioner submits that

petitioner solemnized his second marriage with the consent of

complainant’s daughter and still ready to keep the complainant’s

daughter with full honour and dignity, but I am not, at all, convinced

with the aforesaid submission. Accordingly, his prayer for

anticipatory bail stands rejected.

However, petitioner is directed to surrender before the

learned court below and seek regular bail within thirty days from the

date of communication of this order to S.D.J.M, Sheikhpura in

connection with Complaint Case No. 357 C of 2009 and if petitioner

does so, the learned court below shall consider the regular bail

application of the petitioner on its own merit without being

prejudiced by this rejection order.
