the issue involved in this writ

application is identical.

In this case, however, both

counter affidavit has not been filed

and therefore this Court would give one

more indulgence to the counsel for the

State to file its detailed counter

affidavit, while keeping in view, the

earlier query of this Court by the

order dated 17.01.2005.
